Quoting from my State's published Boating Regulations:

"The Operator of the vessel shall:
1. Without serious danger to the vessel, crew or passengers render to other persons affected such assistance as may be practicable and necessary to save them from any danger caused by an accident."

One would suspect that placing one's own craft in danger of imminent capsize, and one's own person with immersion and expulsion from said craft, would constitute a serious danger to vessel, crew & passenger of one's own kayak.
