The suggestion was not that ethics are flexible.  

It was that a sensitive and cognizant individual
intimately familiar with the circumstances they are
involved in is generally in a superior position to any
local, state, or federal government agency to
determine whether they are acting ethically and
morally as well as if they are following the letter or
at least the spirit of some law that such government
agencies might have enacted for the (presumedly) good
of the governed.

It is not possible to satisfactorily apply black and
white solutions to complex real world situations.
