[Paddlewise] waivers

Hi All,
I have been told that the defensive strength of waivers is different 
in different states. In some states, a waiver will protect an 
incompetent instructor no matter how bad the failure in judgement, 
while in other states the defence MUST prove that the instructor did everything 
reasonably expected of him/her.

It is remarkable that a student would have to sign a waiver regarding 
risks of which they have no knowledge because they are IGNORANT 
students attempting to become educated! In such a case they appear to 
be unable to protect themselves from the instructor's incompetence. 
The waiver suggests that the instructor owes the student NO Guarantee 
of competence.
