The more complex a thing is, the harder it is to copyright -
for instance anyone can make their own Mirage fighter
aircraft (the Israelis did), as long as the copy in detail is
different (in this case a different engine and different avionics), 
as the form itself is nearly impossible to copyright, as it in
itself uses features pioneered by others (the Mirage  being
aerodynamically an almost 100% copy of an earlier British 
design, Fairey Delta II, that did not go into production - same 
wing, same nose length, if fattened to make room for electronics)!

If a kayak is copyright-able, I have no idea, unless it is
built exactly the same way, because then it is a fake!

You are confusing copyright and patents. Copyright is about visual and audio
material. There are 380 current patens that mention the word Kayak.
