I was pulled over yesterday morning, lights and sirens going off, as if
I was the nations most wanted character.  Cowboy cop swaggers up with
more gear and ordinance on his belt than Batman, wants me to step out of
the jeep and show I.D, registration, and insurance papers.  I do so, and
informed that I have violated statute CAL-842-N1013 of the state of
California by not having a red flag measuring 12" x 12" displayed on the
rear of materials cartopped protruding more than 2' from the rear of the
vehicle.  Guilty as hell, big yellow kayak seen for miles, the officer
goes forward to write out the citation and his partner wanders back.
"Lucky for you that he doesn't take you back to the house and whip you:
he's been on the job 2 weeks and is greener than owl shit".  "Give a guy
a gun and a book of statutes and he's ready to clean up the world".  "So
what about this kayaking anyway?; I'm about to retire and my Ethel
doesn't like me hanging around the house".  "Looks like something I
could get into".  We exchange phone numbers, and within hearing of the
other officer, Glenn says, "don't forget that red flag next time or the
pee-wee police might bust you big time".  I call the Court House and am
told that my infraction is $29.50, due and payable within 30 days, after
that I suppose I'll be flogged, whipped, and have my knees broken by an
officer of the state of California..  The moon is in Neptune, and I have
an irrational urge to moon a government official.

    Cute story Nick.  Sorry to hear about the fine though. Very few of us 
ever think about the need to flag the boats. The law is clear enough.  A 
friend just attaches a 2' piece of red webbing to the stern, not enough to 
satisfy the great state of California, but it seems to work well enough 
around here.

Gee, I don't have any trouble with my 14' 8" kayak on my 14' car :^)  I
bought a short kayak because I only had a 13' long living room in my
apartment, but maybe Big Brother was sending me subliminal warning
messages all along.

It's not a petty thing to cite you for having an unflagged oversized
load.  You wouldn't think so if you ran into a ladder or a 2X4 sticking
out  past the end of the truck in front of you.  If you're going to carry
a long kayak, flag it.

        Alas, this varies enormously.  There's probably a Federal guideline
but most states have their own regulations.  New Jersey now requires a red
flag if the thing extends more than 4 feet., for example.  Maryland, the
last time I checked, was more like 2 feet.
        FWIW,  Maryland also limits rack width to lane width, whereas NJ
says rack extensions can be no more than half again the vehicle width.

I carried a kayak on my car top From Houston to South Florida and back qnd
was not stopped.  I didn't check the state laws along the way.  Maybe I was
just lucky.

The Texas Requirements as per the above link (notice these are 1995 laws):

Sec. 547.382.  Lighting Equipment on Projecting Loads.

  (a) A vehicle transporting a load that extends to the rear at
least four feet beyond the bed or body of the vehicle shall
display on the extreme end of the load at the times specified in
Section 547.302(a):

       (1) two red lamps visible at a distance of at least 500 feet
  from the rear;

       (2) two red reflectors that indicate the maximum width and
  are visible at nighttime at all distances from 100 to 600 feet
  from the rear when directly in front of lawful lower beams of
  headlamps; and

       (3) two red lamps, one on each side, that indicate the
  maximum overhang and are visible at a distance of at least 500
  feet from the side.

  (b) At all other times, a vehicle transporting a load that
extends beyond the vehicle's sides or more than four feet beyond
the vehicle's rear shall display red flags that:

       (1) are at least 12 inches square;

       (2) mark the extremities of the load; and

       (3) are placed where a lamp is required by this section.

nonetheless!!!  And I suspect this type of statute is
something we all ought to look into.
